Assault and battery, OUI (Operating under Influence)/DUI (Driving under Influence), Violation of restraining orders are considered high-level offenses. Nowadays, these crimes have become a regular incident in our society.
Definition and punishments of Assault and battery:
When a person orders someone by using force and threats him or her with physical contact (usually raising fists towards the victim), that person is considered an offender in the constitutional rules and laws.
Punishments: Generally, there are two types of penalties for this crime. The penalties are monetary fines, imprisonment.
    • As an offender of this crime, the judge can charge you with a hefty monetary compensation amount. The compensation will depend on the intensity of your offense.
    • The judge can also give the order of imprisonment. The time in prison can also vary with the intensity of the crime.
    • If an offender possesses previous criminal records, the punishment will be harsher than ever.
    What is OUI?
The full form of OUI is Operating under Influence. It is also known as DUI (Driving under Influence). While driving a car, if the driver is found to be intoxicated with alcohol or any drugs, the driver is considered guilty under the constitutional rules and laws. This incident is known as OUI. There are several punishments for this crime: imprisonment, fines, vehicle loss, driver license suspension, etc.
During driving, the permissible limit of alcohol consumption is 30 mg/100 ml. Suppose someone has a greater amount of alcohol than the allowable limit in the breath analyzing test results. In that case, they are considered an offender under the rules of drink and driving under the Influence (DUI).
    • Imprisonment: If someone commits this crime, the judge can give an order to stay in prison (one or five years of jail). In some particular cases, the judge can even give probation to the accused person.
    • Monetary Fines: The judge can charge a hefty amount of compensation to the offender.
    • Vehicle loss: This crime can also lead to the forfeiture of the vehicle. As an alternative, the judge can give the order to immobilize the car for a certain amount of time.
If you are alcohol-addicted, you have to maintain the limit of alcohol consumption during driving. To prove the accusations wrong, you can take legal actions by utilizing OUI Defence. In this procedure, a criminal lawyer fights the case on behalf of you.
    Violation of restraining Orders:
Suppose a person has restraining orders against him/her. If he/she does anything out of order, it means that he/she had violated the orders.
The punishments for violating restraining orders are imprisonment and a monetary fine. If the offender wants to settle the case through negotiations, he/she can execute the plea bargain process by exchanging a plea of guilty.
    Conclusion:
We have to remember that rules and laws are responsible for creating a peaceful society. If we initiate to break those rules and regulations, we have to get punished for the sake of maintaining peace.
